Public Hearing:
Mark Masinda called the Public Hearing to order at 7:33.
ZBA2009-3 Application for 40 ft front yard variance (section 8.03) for proposed house addition and 11 ft front yard variance (section 8.03)for proposed addition of garage bay and roof at 115 Eldredge Road Owner /Applicant: Alfred & Helen Sadow (Received July 9, 2009 Public Hearing August 13, 2009 decision within 65 days after close of P.H.)
Mr. Sadow spoke briefly about his application. He stated that he would like to build a new garage bay and roof. On the north side of the house the bulk head and porch were starting to rot he would like to replace them with a family room.
He stated the hardship is the house was built in 1920 before zoning regulation.
The Board Members review the plans submitted with the application and discussed were the proposed addition and garage would be placed.
Application was complete. No other public was present to speak either for or against the application.
The Board Members held a site walk on July 14, 2009.
Public Hearing closed.
M. Masinda recused himself from ZBA2009-2.
ZBA2009-2 Application for 11ft front yard variance (section 8.03) to rebuild and extend sunroom at 216+8 Luchon Road Owner/Applicant: Mark Masinda (Received July 9, 2009 Public Hearing August 13, 2009 decision within 65 days after close of P.H).
M. Masinda stated he would like to rebuild and extend the existing sunroom,
No other public was present to speak either for or against the application.
M. Masinda said that the hardship is the house pre-exists zoning and property pre-exists town road. A site walk was done by Board Members on July 14, 2009. R. Maloney stated for the record that M. Masinda did recuse himself from the application and did not discuss it with any Board Members.

Annemarie Poole motion to approve a 40ft front yard variance for proposed house addition
and 11ft front yard variance for proposed garage bay and roof at 115 Eldredge Road.
R. Maloney seconded the motion.
Discussion was held on the exact amount of footage requested for the variance.
R. Maloney stated the variance is for the proposal in the application and on the plans entitled “Plan Prepared For Helen M. and Alfred N. Sadow” dated 5/28/09, revised 6/9/09 only.
All voted in favor.

R. Maloney seconded the motion.
Brief discussion was held on the age of the building and the amount of variance requested

Richard Maloney made a motion to approve the minutes of July 9, 2009. Annemarie Poole seconded the motion. All voted in favor.

ZBA2009-4 Appeal of the decision of Zoning Agent (section 7.07.04) 88 River Road (Map 10 Lot 17 Zone R80) Owner/Applicant: Paula Beebe (Received August 13, 2009 Public Hearing by October 8, 2009 decision within 65 days after close of P.H.)
P. Beebe spoke to the Board Members about her appeal. She stated she would like to continue to use the out side stairway, and that the Zoning Agent wanted her to use the inside stair way.
The Board Members discussed the building application and stairs leading to the second floor bedroom addition. Because of the separate access it has the potential to create a separate living space. P. Beebe stated she feels the hardship is the stairway.
Site walk was set for August 19, 2009 at 6:30. Public Hearing will be set for September 10, 2009.
R. Maloney made a motion to adjourn. A Poole seconded the motion. All voted in favor.
